The Litigation Specialist will be responsible handling cases of high complexity and/or exposure. Investigate, evaluate and settle claims within designated authority. This position reports to the Large Loss Manager.
  • Examine claims files, insurance policies and other documentation to determine coverage applicable to a claim loss.
  • Develop a defense plan (strategy) and direct defense counsel on litigated claims.
  • Assists and may direct the investigation and claims settlement activities of attorneys and vendors.
  • Evaluate claim and reserve cases within designated authority on various lines of business both commercial and personal.
  • Settle and pay claims within designated authority. Recommend payment, evaluate and reserve claims in excess of assigned authority. Reports status to the Home Office Claims Department through large loss notices.
  • Attend pre-trial settlement conferences, arbitration and trials on litigated cases as needed.
  • Negotiate settlements directly with insureds, claimants, attorneys, and other insurance companies. May be given cases that are not in litigation but have a trigger exposure.
  • Present cases to the Suit and Roundtable Committees.
  • Perform other duties as assigned.
  • Must exercise budget responsibility with vendors for allocated loss adjustment expense.
  • Must be able to establish rapport with insured, public adjusters, attorneys, law enforcement agencies and other insurance companies.
  • Must have strong negotiation skills.
  • Must be able to function under a heavy volume of work and to make independent decisions regarding investigation, case evaluation and settlement negotiations.

  • Bachelor‚ s degree. Successful completion of AIC, CPCU/SCLA/CCLA/PCLA designation or its equivalent also preferred.
  • Thorough knowledge of claims policies, procedures, and protocols; fair/unfair claims practices regulations, all operating states insurance codes and contracts, civil codes, vehicles codes, arbitration rules and regulations, and legal decisions.‚
  • Demonstrate excellent written and oral communication skills. Must be able to effectively communicate with field claims personnel, executive management, vendors and others, necessary to accomplish goals. Management and time management skills are required to effectively manage the audit/training programs; assist when called upon to resolve complex technical questions, problems and/or complaints; establish and maintain rapport with field personnel, intra-departments, management, vendors, and agents.
  • Requires minimum fifteen years casualty claims adjusting experience with last five years in a senior examiner or equivalent positions.
  • Must be willing to travel, as required.

Don't Be Fooled

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
